CONSTRUCTION RELATED ACCIDENTS

A construction site poses various dangers and, as such, construction workers and visitors to construction sites should at all times wear the necessary safety equipment and adhere to safety protocols in order to avoid construction related accidents.

Common construction related accidents include:

  • Structural failures
  • Explosions
  • Scaffolding falls
  • Electric shocks
  • Crane accidents
  • Ladder accidents
  • Chemical spills and chemical exposure
  • Trench accidents
  • Falling materials such as rock or brick

Even when all the necessary safety precautions are taken, accidents can still happen on the job. In some instances, innocent bystanders can also be injured.

Under South African law, injuries sustained at work must to be reported to the employer and the Workmen's Compensation Commissioner. However, if gross negligence was a factor in an injury, an additional personal injury claim can be made. Furthermore, in cases where a worker is injured due to a defective product or negligence of another party such as a subcontractor, the worker can bring a lawsuit against the negligent party. For example, if scaffolding was defective and caused you to fall, you may have a claim against the manufacturer or a subcontractor who assembled it.
